Introduction
This Code of Conduct and Terms & Conditions outlines the principles, ethical standards, and professional guidelines that all members, associates, and representatives of JMD Real estate must follow.
It serves as the foundation of integrity and transparency in all our business dealings. The purpose of this document is to maintain the dignity of our members, promote ethical real estate practices, foster professional cooperation, and protect the interests of clients, customers, developers, and partners alike.
Our goal is to establish the highest standards of fairness, trust, and accountability within the real estate industry and ensure our collective responsibility toward the community we serve.
- Standards of Professional Conduct
- Realtors and agents must act with honesty, integrity, and fairness in all dealings.
- They must fulfill their fiduciary obligations to clients and protect clients’ interests at all times.
- Realtors must not engage in any activity that could harm the reputation of JMD Real estate or the real estate industry.
- Realtors must avoid misleading clients or customers, providing false information, or withholding information that should be disclosed by law or professional ethics.
- Duty to Report Misconduct
- Any member who has reasonable grounds to suspect another realtor of unethical or improper conduct may report the matter to JMD Real estate’s Compliance Officer.
- Members must not misuse or threaten disciplinary processes for personal or competitive advantage.
- All such reports will be handled confidentially and in accordance with company policy.
- Duties and Obligations of Agents
- All JMD Real estate offices must display these Terms & Conditions prominently and provide access to them on every official website.
- Agents must make a copy of these rules available to any person upon request.
- Every member must be familiar with applicable laws, RERA guidelines, and JMD Real estate’s internal policies.
- Supervision and Management
- Business owners or team leaders must ensure all employees, salespersons, and associates are adequately trained, supervised, and informed about industry practices and regulations.
- Continuing education and periodic compliance training are encouraged to maintain high standards.
- Supervisors must monitor the accuracy of property information and communication shared with clients.
- Client and Customer Care
- Realtors must always act in the client’s best interest and in accordance with lawful instructions.
- Realtors must communicate promptly, clearly, and regularly with clients about matters relevant to their property or transaction.
- Clients and customers must not be pressured or misled in any transaction.
- Realtors must ensure that all property access or visits are properly authorized.
- Without written authorization from a client, no property may be marketed, advertised, or listed publicly.
- Agency Agreements and Contractual Documents
Before a client signs any agency, sale, or purchase agreement:
- The Realtor must recommend the client seek legal advice.
- The client must be given adequate time to review documents and obtain expert input.
- The Realtor must ensure that all material details are correctly included in any document before signature.
- Commission terms, marketing expenses, and validity of the agreement must be clearly stated and acknowledged by the client in writing.
- Conflicts of Interest
- Realtors must disclose any situation that may present a conflict of interest.
- A Realtor must not receive or claim more than one commission for the same transaction.
- Realtors must not engage in external business activities that may compromise their professional responsibilities at JMD Real estate.
- Confidentiality
- Realtors must maintain the confidentiality of all client and transaction-related information.
- Confidential data must not be shared with third parties without written client consent, unless required by law.
- Personal information must be handled in accordance with JMD Real estate’s Privacy Policy and relevant data protection regulations.
- Client Care for Sellers’ Agents
- Property appraisals must be realistic, supported by current market data, and provided in writing.
- Any lack of comparable data must be disclosed and explained to the client.
- Advertised prices must reflect client-approved expectations.
- Realtors must explain how different sales methods (e.g., exclusive, open listings) affect potential benefits or costs.
- Agency Agreements
- Before signing, the Realtor must explain in writing:
a. How and when commission is payable.
b. When the agreement starts and ends.
c. How the property will be marketed, and any associated expenses. - All parties must retain a signed copy of the agreement.
- Disclosure of Defects
- Realtors must disclose any known defects in the property or title to prospective buyers.
- Realtors must make reasonable efforts to verify the accuracy of property details and avoid misrepresentation.
- When necessary, independent expert assessments should be recommended.
- Advertising and Marketing
- Realtors must only advertise or market properties authorized by the client in writing.
- All advertisements must be truthful, accurate, and compliant with applicable laws and advertising standards.
- Misleading visuals, claims, or price representations are strictly prohibited.
- Documentation and Record Keeping
- Realtors must document all written offers, agreements, and client communications.
- A copy of every written offer must be retained for a minimum of 12 months.
- Records must be stored securely and made available for internal audits when required.
- Complaints and Dispute Resolution
- JMD Real estate maintains written procedures for handling complaints and resolving disputes fairly.
- Clients must be informed of these procedures before entering into agreements.
- Complaints should be directed to info@jmdReal estate.in, where they will be reviewed promptly and impartially.
- Brokerage and Fees
- All commission, brokerage, or service fees must be confirmed in writing with clients and include applicable government taxes.
- If special packages or fee structures are offered by builders or developers, they must be clearly documented in client agreements.
- Transparency in pricing, service scope, and government levies is mandatory.
